2. Plant Identification & Toxicity Disclaimer
Accuracy Limitations: AI analysis is not error-free and should not be relied upon as definitive botanical identification.
Ingestion & Toxicity Warning: NEVER INGEST, FEED TO ANIMALS, OR PHYSICALLY HANDLE UNFAMILIAR PLANTS, FUNGI, BERRIES, OR SEEDS BASED ON OUTPUTS FROM THE APP. Always consult a qualified botanist, agricultural authority, or poison control center before interacting with or consuming unknown flora.
No Medical or Health Liability: Verno accepts no liability for injury, illness, allergic reactions, poisoning, or death resulting from reliance on the App.
3. General Advisory & Property Disclaimer
No Professional Advice: Outputs provided by the App do not constitute professional arboricultural, engineering, land surveying, legal, or landscape architecture advice.
No Property Liability: Verno is not liable for any direct or indirect damage to property, soil, structures, utilities, or plant life resulting from actions taken based on the App's recommendations. Always consult a licensed professional before undertaking major outdoor work or plant removal.
4. Local Laws & Compliance
User Responsibility: You are solely responsible for ensuring that any planting, pruning, or removal of flora complies with your local municipal bylaws, Homeowners Association (HOA) rules, strata/leasehold covenants, protected species laws, and regional biosecurity mandates.
5. Subscriptions, Content Gating & Fair Use
Access Tiers: Free accounts provide limited access and summary insights. Paid subscription tiers unlock expanded advice and higher usage allowances as presented at the point of purchase.
Fair Use & Infrastructure Caps: To prevent automated abuse and maintain service performance, all accounts are subject to rate limiting and fair use thresholds. Verno reserves the right to throttle or suspend accounts demonstrating non-personal or automated usage.
Auto-Renewal: Paid subscriptions automatically renew unless canceled at least 24 hours prior to the end of the current billing cycle through your mobile app store settings.
Price Changes: Any promotional offers or initial billing rates apply to the specified term only. Renewal rates are subject to change, provided you are notified in advance in accordance with applicable platform policies and local consumer laws.
6. Platform Limits & Capacity Constraints
Operational Thresholds: To maintain platform stability, manage infrastructure performance, and ensure a reliable user experience, Verno enforces reasonable operational limits on account data (including, without limitation, the maximum number of saved gardens, defined garden zones/areas, and tracked plants per profile).
Limit Notifications: You will be notified within the App interface when an account capacity limit is reached. Verno reserves the right to adjust, modify, or enforce these technical thresholds from time to time to protect system integrity.
7. Limitation of Liability & Consumer Rights
Warranty Disclaimer: To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without warranties of any kind.
Limitation of Liability: Verno and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the App.
